Ok so since I had no idea about that until mentioned, I looked into it, and what happened was that a user on ResetEra named shotopunx posted this all back on February 27th:@Vergeben In max's recent vid, he said that some source stated that there would be 39 characters. Sounds too good to be true, does your source have any info on that?

That should be obvious what's being said is bullshit if they're talking about unique characters.
IF they're counting bonus filler throwaway CAS created characters from the story mode actually being playable, then there may possibly be something to the claims.
For instance, if they're doing something where it's a mix of what SCIV did with characters like Dürer and Azola (which could be thrown together in CAS) but wind up under a bonus dedicated character slot like SCIII handled Chronicles of the Sword mode characters, then I guess it's possible.
